These Terms of Service apply to purchases from and use of the SeaGalls Design Studio website. By visiting our website or purchasing from us, you agree to these terms.

ONLINE STORE TERMS

You must be legally capable of entering into a purchase agreement to place an order. You may not use our products or website for unlawful or unauthorized purposes.

PRODUCTS AND SERVICES

We make reasonable efforts to display product colors, designs and images accurately. Actual colors may vary slightly because of differences in screens, garment materials, dye lots and printing processes.

Product availability, colors, sizes, materials and pricing may change without notice. We may limit quantities, discontinue products or refuse an order when reasonably necessary.

CUSTOM AND PERSONALIZED ORDERS

Customers are responsible for reviewing and approving all names, spelling, dates, colors, sizes, artwork and other customization details before production.

Approval of a proof authorizes SeaGalls Design Studio to produce the order as shown. Custom, personalized and made-to-order items cannot be changed, canceled, returned or exchanged after materials have been ordered or production has begun, except when an item is damaged, defective or different from the approved design or order.

Customers submitting artwork, logos, photographs or other materials confirm that they own the materials or have permission to use and reproduce them. The customer is responsible for claims arising from materials supplied without proper authorization.

ORDERS AND PAYMENT

All prices are listed in United States dollars. Applicable taxes, shipping charges and other fees are displayed during checkout when required.

Payment must be successfully authorized before an order is processed. We reserve the right to cancel or refuse orders containing incorrect pricing, suspected fraud, unauthorized artwork or other errors. If payment has already been collected for a canceled order, an appropriate refund will be issued.

ORDER PROCESSING AND FULFILLMENT

Processing and production times vary depending on the product, order quantity, customization and current workload. Any completion or delivery date provided is an estimate unless expressly guaranteed in writing.

Shipping carrier delays and other circumstances outside our reasonable control may affect delivery times. Customers are responsible for providing accurate contact, delivery and pickup information.

LOCAL PICKUP

Customers selecting local pickup must wait until they receive confirmation that their order is ready. Pickup days and hours may vary and will be communicated separately. Placing an order does not guarantee same-day or next-day pickup.

RETURNS AND REFUNDS

Returns, exchanges, cancellations and refunds are governed by our published Return and Refund Policy. Please review that policy before placing an order.

WEBSITE INFORMATION

We try to keep product descriptions, pricing, availability and other website information accurate. Occasional errors or omissions may occur. We may correct errors, update information or cancel affected orders when necessary.

INTELLECTUAL PROPERTY

The SeaGalls Design Studio name, branding, website content, original artwork, photographs and designs are protected by applicable intellectual-property laws. They may not be copied, reproduced, resold or used commercially without written permission.

School names, mascots, logos and other third-party marks remain the property of their respective owners. Any use of third-party branding is subject to applicable authorization and ownership rights.

PROHIBITED USES

You may not use this website to engage in unlawful activity, violate intellectual-property rights, submit malicious code, collect information about others without authorization, interfere with website security or attempt to misuse the website or its services.

THIRD-PARTY SERVICES

Our store may use or link to services operated by third parties, including Shopify, payment providers and shipping carriers. We are not responsible for the content, availability or practices of independent third-party services.

DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. We do not guarantee that access will always be uninterrupted, secure or error-free.

Nothing in these terms limits warranties or consumer rights that cannot legally be excluded.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, SeaGalls Design Studio will not be liable for indirect, incidental, special or consequential losses arising from use of the website or purchase of our products.

Our total liability relating to a particular order will not exceed the amount paid for that order, except where a different limitation is required by law.

INDEMNIFICATION

You agree to indemnify and hold SeaGalls Design Studio harmless from claims, losses or expenses resulting from your violation of these terms, unlawful use of the website or unauthorized use of artwork or other materials you provide.

SEVERABILITY

We may suspend or terminate access to the website when these terms are materially violated. Obligations incurred before termination will continue to apply.

These terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law principles.
